Unlicensed Drivers

Automobile Accidents, Unlicensed Drivers, Naples FL Attorneys

Being involved in an automobile accident can be a difficult and stressful situation for anyone, but for drivers in the state of Florida who are unlicensed, the legal issues they may face are much more severe than those faced by licensed drivers. In addition to the damages they or their insurance company may have to pay, an unlicensed driver is subject to legal ramifications if they have been involved in an auto accident. To help you better understand the penalties you may face as an unlicensed driver in Florida, the law firm of Feingold & Posner have put together a brief primer explaining the state law regarding driving without a license.

First Offense

If you have been involved in an accident while driving without a license and it is your first offense, you can be convicted of a 2nd degree misdemeanor under Florida law. If you are convicted, you face a penalty of up to 60 days in jail as well as a $500 fine.

Second Offense

A second offense of driving without a license can result in being charged with and convicted of a 1st degree misdemeanor. This carries a penalty of up to one year in jail, as well as a $1000 fine.

Accidents causing serious injury or death

In the case of an automobile accident that causes serious injury or death, the penalties for driving without a license are much more severe. An unlicensed driver that has caused an accident that results in the serious injury or death of another can be charged with and found guilty of a 3rd degree felony under Florida state law. The penalties for being found guilty of this can result in up to five years in prison, as well as a fine of $5000. In addition, the state of Florida has the right to impound your vehicle, and the other driver can sue you for damages related to the accident.
